1. Acceptance of Terms
By accessing or using SplitWin ("the Service"), operated by SolutionC LLC ("we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
SplitWin is an AI-powered A/B testing and conversion rate optimization platform. The Service allows you to create page variants, track visitor interactions, and optimize website copy using artificial intelligence.
3. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Interfere with or disrupt the Service's infrastructure
- Attempt to gain unauthorized access to other accounts or systems
- Use the Service to collect data in violation of privacy laws
- Resell or redistribute the Service without a White Label plan
- Send spam, phishing, or misleading content through the Service
5. Subscription Plans & Billing
Paid plans are billed monthly via Stripe. You may cancel at any time; access continues until the end of your billing period. We do not offer refunds for partial months. Plan limits (pages, sessions, AI generations) reset monthly.
6. AI-Generated Content
SplitWin uses AI (Anthropic Claude) to generate variant copy. AI-generated content is provided "as-is". You are responsible for reviewing and approving all AI-generated variants before they go live on your website. We do not guarantee specific conversion improvements.
7. Data & Privacy
We collect and process data as described in our Privacy Policy. By using the Service, you consent to such processing. You are responsible for ensuring that your use of the Service complies with applicable data protection laws in your jurisdiction.
8. Intellectual Property
The Service, including all code, design, and documentation, is owned by SolutionC LLC. Your data remains yours. White Label plan users receive a license to rebrand and redistribute the platform under the terms of their subscription.
9. Service Availability
We strive for high uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications at any time. We are not liable for any loss caused by downtime or service interruptions.
10. Limitation of Liability
To the maximum extent permitted by law, SolutionC LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your account if you violate these Terms. You may close your account at any time by contacting support. Upon termination, your data will be deleted within 30 days.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. We will notify you of material changes via email or in-app notification.
